This website is operated by MESDATA. By using mesdata.co you agree to these terms. If you use the site on behalf of a company or other organization, you confirm that you have authority to bind it.
If you do not agree, do not use the site. Nothing here excludes or limits liability that cannot lawfully be excluded, including for fraud, death or personal injury caused by our negligence.
02Nothing here is a product
MESDATA is not yet released. Everything on this page describes an intention: what we think manufacturing data should look like, and what we plan to build.
- References to features, capabilities, standards conformance, timings or availability are indicative only and may change or be dropped.
- Nothing on the site is an offer to sell, a quotation, a commitment to deliver, or a warranty that any product will exist.
- Requests for early access create no rights to access, and we decide who participates in the preview.
- Statements about your own systems on this page, in email, or in a conversation are not representations by us about them.
Any commercial relationship will be governed by a written agreement signed by both parties. If that agreement and these terms conflict, the signed agreement prevails.
03Who may use the site
The site is for business use by people aged 18 or over. By using it you confirm that you are legally able to enter into these terms and that your use does not breach any law or obligation applying to you.
04Acceptable use
You agree that you will not:
- Use the site for any unlawful purpose, or in a way that infringes our rights or anyone else’s.
- Transmit malware, or attempt to probe, scan, test or breach the site’s security or authentication.
- Interfere with, overload or disrupt the site or the systems that deliver it, including by automated access that exceeds what a normal browser does without our prior written permission.
- Scrape, harvest or systematically extract content or any personal data from the site.
- Impersonate any person or organization, misstate your affiliation with us, or use the MESDATA name, marks or domain in a way that suggests endorsement.
- Send us large volumes of unsolicited or automated messages.
05Your enquiries
When you email us you keep ownership of what you send. You grant us permission to store, read, forward internally and respond to it, and to contact you about the subject of your message. We handle the personal data in your message as set out in our privacy policy.
06Feedback and ideas
Comments about MESDATA — on the product, the data model, standards, or what you would need in order to use it — are welcome and will shape what we build. So that we can act on them, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive licence to use, reproduce, modify and build on that feedback for any business purpose, without attribution or compensation to you.
This applies to feedback about MESDATA only. It does not transfer ownership of your manufacturing data, your documentation or your own intellectual property to us.
07Intellectual property
The site and everything we created for it — text, graphics, the MESDATA name and logos, layout, and any software — are owned by us or our licensors and protected by copyright, trade mark and other law. You may view the site, print or share a single copy for your own internal assessment, and link to it.
No licence or right is granted to you beyond that. You may not copy, reproduce, republish or adapt a substantial part of the site, register or attempt to register any of our marks or confusingly similar names or domains, or remove proprietary notices, without our prior written permission.
08Third parties
The site loads typefaces from Google Fonts, and may in future link to documents, standards bodies or other sites we do not control. Those parties collect your IP address as part of serving the request and operate under their own terms and privacy policies. References to third parties, including standards such as ISA‑95, are descriptive: they do not imply endorsement by, or affiliation with, anyone.
09Disclaimers
The site is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including satisfactory quality, fitness for a particular purpose, accuracy, and compatibility with your systems. We do not warrant that the site will be uninterrupted, error-free, secure, or free of harmful components, and we do not guarantee that it will remain available or unchanged. We make no representation that material on the site is appropriate or lawful in any particular jurisdiction.
10Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, production, anticipated savings, business opportunity, goodwill, or data, arising out of or in connection with your use of, or inability to use, the site.
Our aggregate liability arising out of or in connection with the site is limited to $100. These limits apply whatever the form of the claim and do not apply to liability that cannot lawfully be limited.
11Indemnity
You will defend, indemnify and hold us harmless against claims, losses and reasonable costs, including legal fees, arising from your breach of these terms, your misuse of the site, or your infringement of anyone’s rights.
12Access and suspension
We may modify, suspend or discontinue the site, or restrict access to it, at any time and without notice, including where we reasonably believe you have breached these terms or put the site, our users or our systems at risk. Where practical, and where you have given us a way to reach you, we will tell you why.
13Changes to these terms
We may update these terms from time to time. The version in force is the one published on this page at the time you used the site, and the “last updated” date above shows when it last changed. Using the site after an update means the updated terms apply to that use.
14Severance and assignment
If a provision of these terms is found unenforceable, the rest continue in effect and the unenforceable provision is replaced by one that achieves its intent as closely as the law allows. These terms are between you and us and are not enforceable by anyone else. You may not assign them; we may assign them in connection with a merger, re-organization or sale of assets. A delay in enforcing these terms is not a waiver.
15Governing law
These terms are governed by the law of Singapore, and the courts of that jurisdiction have exclusive jurisdiction over disputes arising from them — without affecting any mandatory consumer rights you may have where you live.
